Terms of Service

1. Acceptance of Terms

By accessing or using the BogeyMap website at https://bogeymap.com and any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Chaddy Golf Ventures LLC d/b/a BogeyMap ("Company").

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page with a revised "Last updated" date, a pop-up window notifying you of changes, or by sending you an email notifying you of the changes. Your continued use of the Service thereafter constitutes your acceptance of the new Terms.

2. Description of Service

BogeyMap is an informational platform that aggregates, analyzes, and presents golf course ratings and information for public and semi-private golf courses across all 50 US states. The Service includes:

  • The LooperScore system, a proprietary course rating calculated using BogeyMap's independent algorithm.
  • Looper, an AI-powered golf assistant that provides course recommendations, course intelligence, and general golf information.
  • Architect's Corner, an editorial resource profiling notable golf course architects.
  • User-submitted course reviews and ratings.
  • Course search, filtering, and mapping tools.

3. Eligibility and Account Registration

The Service is intended and offered only for use by individuals located in the United States. You may access or use the Service only if you: (a) are at least 18 years old and have reached the age of majority where you reside; (b) have the legal capacity to enter into a binding contract; and (c) reside in and access the Service from the United States. By accessing or using the Service, you represent and warrant that you satisfy these requirements. You may not access or use the Service if you are under 18 or located outside the United States.

To access certain features (such as submitting reviews or obtaining a Verified Golfer status), you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

When you create an account, submit User Content, report content, apply to the reviewer program, or purchase a subscription, you must affirmatively confirm that you are at least 18 years old. We record that confirmation, together with the date and time it was given. We also use the approximate country associated with your internet connection (derived from your IP address) to determine whether these actions are available to you, and we may decline them where that country is not the United States. This location screening is approximate and may occasionally be inaccurate; it does not relieve you of your representations in this Section, and browsing features may remain accessible from outside the United States without creating any account rights.

4. User Content and Reviews

4.1 Your Content

You may submit course reviews, ratings, and other content ("User Content") to the Service. You alone are responsible for User Content and, once submitted, it cannot always be deleted. You assume all risks associated with User Content. By submitting User Content, you represent and warrant that: (a) you are the original author of the content or have the right to submit it; (b) the content is accurate and reflects your genuine experience; (c) the content does not infringe any third-party intellectual property rights; (d) the content does not contain defamatory, obscene, harassing, or otherwise unlawful material; and (e) you have the right to grant the license below.

4.2 License Grant

By submitting User Content, you grant Chaddy Golf Ventures LLC d/b/a BogeyMap a non-exclusive, worldwide, royalty-free, perpetual, assignable, sublicensable, transferable, irrevocable license to host, use, reproduce, modify, adapt, publish, translate, distribute, publicly display, and otherwise use your User Content in connection with the Service, internal business purposes, promotional purposes, or any other purpose. You retain ownership of your User Content. See AI Powered Features, below, for further details about how we may use your User Content.

4.3 AI Powered Features

To operate, improve, and personalize the Services, we may use User Content, including reviews, ratings, comments, and other content you submit, to develop, train, test, evaluate, and improve artificial intelligence, machine learning, recommendation, search, ranking, summarization, and other automated features that are part of the Services.

These uses may include identifying trends, generating recommendations, matching users with relevant content, improving search results, detecting duplicate or fraudulent content, and developing new features designed to enhance the user experience.

Except as otherwise disclosed in our Privacy Policy, we will not intentionally identify you personally in AI-generated outputs provided to other users. Where appropriate, we may aggregate, anonymize, or de-identify User Content before using it for these purposes.

You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use your User Content for the purposes described in these Terms during the period your User Content is available on the Services and thereafter to the extent reasonably necessary to preserve previously developed AI models, maintain the integrity of the Services, comply with applicable law, or otherwise exercise rights granted under these Terms.

4.4 Anonymization of User Content

You may request that we dissociate your User Content from your personal profile or other identifying account information by contacting us or using the account tools we make available.

Upon processing your request, we may replace your name, username, profile photograph, and other identifying account information associated with your User Content with an anonymous identifier or otherwise de-identify the User Content so that it is no longer publicly associated with your account.

Anonymization of User Content does not require us to remove the underlying content itself. Unless otherwise required by applicable law, we may continue to host, display, reproduce, distribute, and otherwise use such User Content pursuant to the license you granted under these Terms, provided that it is no longer publicly associated with your personal profile.

Certain information may remain associated with your account or retained by us where reasonably necessary to:

  • comply with applicable law or legal process;
  • maintain the integrity, security, or operation of the Services;
  • investigate fraud, abuse, or violations of these Terms;
  • preserve audit logs, backups, or disaster recovery systems;
  • protect the rights, property, or safety of the Company, our users, or others.

We do not guarantee that anonymization will remove all references to your identity. For example, your identity may remain apparent from the content itself, from quotations or responses posted by other users, or from information independently disclosed by you or others.

4.5 Content Moderation, Automated Screening, and Reporting

We reserve the right (but have no obligation) to review, edit, or remove any User Content at our sole discretion, for any reason or no reason, and without notice to you, including content that violates these Terms or that we find objectionable for any reason. We are not responsible for User Content submitted by other users.

User Content you submit is screened by automated means, including artificial intelligence, before it becomes publicly visible. That screening evaluates the text you submit for indicators such as defamatory statements, unverifiable factual claims, third-party personal information, harassment or hate speech, and spam or off-topic content, and produces a preliminary classification. Content the system does not clear is held for human review before publication, and content the system identifies as clearly unacceptable may be withheld or hidden. We are not obligated to publish any User Content, and publication may be delayed, declined, or reversed at any time. Automated screening is imperfect and does not constitute a legal determination about your content; a decision to publish is not an endorsement or verification of accuracy.

Editing a published review returns it to screening and may remove it from public view until it clears again.

Any signed-in user may report published User Content using the reporting control available with each review. Reports must be made in good faith; submitting repeated, knowingly false, or abusive reports is a violation of these Terms. A reported item may be re-screened and, where appropriate, hidden pending our decision. We decide whether to remove, restore, or take no action, and we are not obligated to notify a reporter of the outcome. Nothing in this Section limits your obligation to raise defamation, privacy, or intellectual-property claims through the notice procedures described elsewhere in these Terms.

4.6 Content Guidelines

Our community benefits from honest, informative, and respectful reviews. Whether your experience was positive, negative, or somewhere in between, we encourage you to share it in a way that is fair, accurate, and helpful to other users. Our published Review Guidelines set out in detail what we publish, what we hold for human review, and what we remove.

When posting a review, please:

  • Share only experiences that are based on your own firsthand knowledge or personal interactions.
  • Be truthful and accurate to the best of your knowledge.
  • Distinguish factual statements from personal opinions.
  • Provide enough detail to make your review useful to others, where appropriate.
  • Keep your comments respectful and focused on the relevant business, organization, product, service, or experience.
  • Update or correct your review if you later discover that material information was inaccurate.

Please do not post reviews that:

  • Are knowingly false, misleading, or deceptive.
  • Include defamatory or libelous statements.
  • Contain threats, harassment, hate speech, or abusive language.
  • Infringe another person's intellectual property or privacy rights.
  • Include confidential or proprietary information that you are not authorized to disclose.
  • Contain another person's personal information (such as home addresses, telephone numbers, email addresses, financial information, or government identification numbers) without their consent.
  • Promote illegal activity.
  • Are spam, advertisements, or solicitations unrelated to the subject of the review.
  • Are posted on behalf of another person without authorization or otherwise misrepresent your identity or experience.
  • Are generated for the purpose of manipulating ratings or misleading other users.

We will not remove or edit reviews solely because they express an unfavorable opinion, provided they otherwise comply with these Guidelines.

4.7 Verified Golfer Status

Certain users may be designated as "Verified Golfers" based on criteria we establish. Verified status is granted at our sole discretion and may be revoked at any time. Verified status does not constitute an endorsement of any particular user or their reviews.

4.8 Accredited Reviewer Program

We offer an optional program in which eligible subscribers may apply to be designated as accredited reviewers and to have their reviews highlighted as featured content. Eligibility criteria, application review, accreditation, and the selection of featured reviews are determined at our sole discretion, and accreditation may be declined, paused, or revoked at any time without notice. Accreditation is not employment, agency, partnership, or a franchise, and it does not entitle you to compensation, course access, complimentary play, or any other benefit unless we agree otherwise in a separate written agreement.

If you are accredited, you agree to visit and evaluate courses at your own risk and expense, to comply with each facility's rules and with all applicable laws, to identify yourself honestly, and to disclose any free or discounted play, gift, payment, or other consideration you receive in connection with a review. You are solely responsible for your conduct at any facility, and we are not responsible for it. Accredited reviews remain your own opinions and are not our statements; the accredited designation is not a representation by us that a review is accurate.

We may in the future offer arrangements in which a course or other third party requests or pays for a review visit. Where a review results from such an arrangement, we will disclose that relationship in connection with the review. Payment never entitles a course to a favorable review, to edit or approve a review, or to have a review removed.

Information you submit in an application (including your region, playing history, and writing samples) is used to evaluate that application as described in our Privacy Policy. Accreditation may require an active subscription in good standing, and lapse of that subscription may affect your eligibility to submit new accredited reviews.

5. Prohibited Conduct

You agree not to: (a) use the Service for any unlawful purpose or in violation of these Terms; (b) submit false, misleading, or fraudulent reviews or ratings; (c) impersonate any person or entity; (d) attempt to gain unauthorized access to any part of the Service or its related systems; (e) use automated tools (bots, scrapers, crawlers) to access or collect data from the Service without our express written permission; (f) interfere with or disrupt the integrity or performance of the Service; (g) upload or transmit viruses or other malicious code; (h) harass, threaten, or harm other users; (i) use the Service to send unsolicited commercial messages (spam); or (j) reverse engineer, decompile, or disassemble any part of the Service.

6. Intellectual Property

6.1 Our Content

The Service and its original content, features, and functionality — including but not limited to visual interfaces, interactive features, graphics, design, compilation (including, but not limited to, our selection, aggregation, and arrangement of User Content and other service content), the LooperScore algorithm, Looper AI system, Architect's Corner editorial content, course data compilations, BogeyMap branding, software, and all other elements and components of the Service (excluding User Content) — are owned by Chaddy Golf Ventures LLC d/b/a BogeyMap and are protected by copyright, trademark, trade dress, trade secret, and all other intellectual property rights and laws. You may not sell, license, copy, publish, reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use or exploit the Service Content in whole or in part without our express written permission.

6.2 Trademarks

"BogeyMap," "LooperScore," "Looper," and "Architect's Corner" are trademarks of Chaddy Golf Ventures LLC. You may not use these marks without our prior written consent.

7. Third-Party Services and Links

The Service integrates with or links to third-party services including Google Maps, Stripe (for payment processing), Lovable (for application hosting, database, and AI infrastructure), and other providers. Your use of these third-party services is governed by their respective terms of service and privacy policies. We are not responsible for the practices of any third-party services.

Your use of certain features of the Service using Google Maps Platform and related services is subject to Google's then-current versions of the: (1) Google Maps End User Additional Terms of Service found at https://maps.google.com/help/terms_maps/; and (2) Google Privacy Policy at https://policies.google.com/privacy. Google Maps content is provided by Google and its licensors. We do not own or control such content, and your use of Google Maps features must comply with Google's applicable terms.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; (B) ANY INFORMATION OR CONTENT ON THE SERVICE IS ACCURATE, COMPLETE, OR CURRENT; (C) THE SERVICE WILL MEET YOUR REQUIREMENTS; OR (D) ANY DEFECTS IN THE SERVICE WILL BE CORRECTED.

COURSE RATINGS, REVIEWS, AND RECOMMENDATIONS PROVIDED THROUGH THE SERVICE ARE FOR INFORMATIONAL PURPOSES ONLY. BOGEYMAP DOES NOT GUARANTEE THE ACCURACY OF ANY COURSE INFORMATION, RATINGS, OR AI-GENERATED RECOMMENDATIONS. ALWAYS VERIFY COURSE CONDITIONS, FEES, AND AVAILABILITY DIRECTLY WITH THE GOLF COURSE BEFORE MAKING TRAVEL OR BOOKING DECISIONS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHADDY GOLF VENTURES LLC D/B/A BOGEYMAP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH: (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) ANY CONTENT OBTAINED FROM THE SERVICE; (C) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; OR (D) ANY OTHER MATTER RELATING TO THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

10. Indemnification

You agree to indemnify, defend, and hold harmless Chaddy Golf Ventures LLC d/b/a BogeyMap and its officers, directors, employees, agents, and licensors from and against any third-party claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your User Content; (c) your use of the Service; or (d) your violation of any third-party rights. We reserve the right, at our expense, to participate in the defense of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims. You agree not to settle any such matter without our prior written consent, which shall not be unreasonably withheld. We will use reasonable efforts to notify you of any such claim, action or proceeding upon becoming aware of it.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Essex County, Massachusetts, and you consent to personal jurisdiction in those courts.

12. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause or notice, including if we believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Assignability

These Terms and any rights or obligations hereunder are not assignable, transferable, or sublicensable by you except with our written consent, but may be assigned or transferred by us without restriction. Any attempted assignment by you shall violate these Terms and be void.

14. Severability and Waiver

If any provision of these Terms is found to be unenforceable or invalid by an arbitrator or a court of competent jurisdiction, then only that provision shall be modified to reflect the parties' intention or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15. Changes to the Service

BogeyMap reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice to you. We may also update, change, or remove features, content, or functionality of the Service at our discretion. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

16. Subscription, Billing, and Cancellation

16.1 Looper Pro Subscription

BogeyMap offers an optional paid subscription called Looper Pro, available on a monthly basis or an annual basis billed as a single annual charge. All prices are in US dollars and are subject to change with notice. Applicable taxes may be added at checkout.

16.2 Free Trial

New subscribers who have not previously activated a Looper Pro trial may be eligible for a 7-day free trial. To start the trial, a valid payment method is required at checkout. You will not be charged during the 7-day trial period. If you do not cancel before the end of the trial period (Day 8), your subscription will automatically convert to a paid monthly or annual plan at the then-current price, and your payment method will be charged accordingly. The free trial is non-transferable, available once per account, and may not be combined with other promotional offers. To cancel before being charged, visit your account page and select "Cancel Subscription" before the trial ends.

16.3 Automatic Renewal

Your Looper Pro subscription automatically renews at the end of each billing period (monthly or annual, as selected) unless you cancel before the renewal date. By subscribing, you authorize BogeyMap to charge your payment method on a recurring basis at the then-current subscription price. You will receive access to Looper Pro features for the full paid period.

16.4 Cancellation

You may cancel your Looper Pro subscription at any time by visiting your account settings and selecting "Manage Subscription," or by contacting us at legal@bogeymap.com. Cancellation takes effect at the end of your current billing period — you will retain Looper Pro access until that date and will not be charged for the next period. Cancellation is as simple as the original sign-up process.

16.5 Refunds

All subscription fees are non-refundable except as required by applicable law. We do not provide refunds or credits for partial billing periods. If you believe a charge was made in error, please contact us within 30 days of the charge at legal@bogeymap.com and we will review your request.

16.6 Payment Processing

Payments are processed by Stripe, Inc. By subscribing, you agree to Stripe's terms of service. BogeyMap does not store your full payment card information.

17. Access Intel Disclaimer

The Access Intel feature provides general informational guidance about ways certain private golf courses may be accessible to non-members, including through resort hotel stays, shoulder-season public windows, and charity or member-guest events. This information is provided for informational purposes only and is not a guarantee of access.

Access policies at private clubs change frequently and without notice. BogeyMap makes no representation or warranty that any access window, resort partnership, or event listed in Access Intel is currently available or accurate. You must independently verify all access information directly with the relevant golf course or resort before making any travel or booking decisions. BogeyMap is not liable for any costs, losses, or disappointments arising from reliance on Access Intel information.

18. DMCA Copyright Policy

BogeyMap respects the intellectual property rights of others and expects users to do the same. If you believe that content on the Service infringes your copyright, please send a written notice to our designated DMCA agent containing the following information: (a) a description of the copyrighted work you claim has been infringed; (b) the URL or location of the allegedly infringing material; (c) your contact information; (d) a statement that you have a good faith belief that the use is not authorized by the copyright owner; (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf, and (f) the signature of the copyright owner or an authorized agent.
